4. OCLMart's Marketplace Role
4.1. OCLMart operates an online marketplace through which approved sellers may list products and customers may place orders.
4.2. Unless expressly stated otherwise for a particular transaction, OCLMart does not manufacture every product listed on the website and may not be the legal seller of products offered by third-party sellers.
4.3. The identity of the seller, the party responsible for fulfilling an order, and any applicable delivery or warranty arrangements should be disclosed where relevant to the transaction.
4.4. OCLMart may provide additional services, including product promotion, order coordination, payment facilitation, warehousing, logistics coordination, and fulfilment, depending on the product, seller, destination, and service selected.
4.5. OCLMart will take reasonable steps to support transactions on the platform. However, we cannot guarantee that every seller will remain available, every listing will remain in stock, or every product will meet a customer’s expectations.
4.6. Nothing in these Terms removes any rights or obligations imposed on OCLMart or a seller by applicable consumer protection or other laws.
5. Product Listings and Information
5.1. Sellers are responsible for ensuring that their product listings are accurate, lawful, and not misleading.
5.2. Product listings may include descriptions, photographs, specifications, prices, sizes, colours, availability, country of origin, warranty information, and other relevant details.
5.3. Product images are provided for illustration or identification where appropriate. Actual products may have minor differences in colour or appearance due to lighting, display settings, manufacturing updates, or other legitimate reasons. Material differences from the advertised product must be handled in accordance with applicable law and our return policy.
5.4. Customers should review the product description, specifications, compatibility, quantity, warranty, delivery information, and seller details before placing an order.
5.5. OCLMart may correct errors, update listings, remove inaccurate information, or suspend a listing where reasonably necessary.
5.6. If a product is materially different from its description, counterfeit, unsafe, defective, or otherwise non-compliant with applicable law, customers may have remedies under our Return, Refund & Cancellation Policy and applicable law.
6. Prices, Currency, and Taxes
6.1. Product prices will be displayed on the website in the currency indicated for the relevant listing or transaction.
6.2. Unless expressly stated otherwise, the displayed product price may exclude delivery charges, customs duties, import taxes, handling charges, or other applicable fees.
6.3. Any additional charges known and applicable at checkout should be disclosed before the customer confirms the purchase.
6.4. For cross-border transactions, the final amount payable may depend on the selected currency, payment provider, exchange rate, destination country, customs assessment, and delivery arrangements.
6.5. Customers are responsible for charges expressly allocated to them at checkout or under the agreed transaction terms, subject to applicable law.
6.6. OCLMart reserves the right to correct genuine pricing errors before accepting an order. If an order cannot be fulfilled at the displayed price, the customer will be informed and given an appropriate opportunity to confirm or cancel the affected order. Any payment collected for an order that is cancelled must be handled in accordance with applicable law.
7. Orders and Order Acceptance
7.1. When you place an order, you are submitting a request to purchase the selected product under the terms displayed at checkout.
7.2. An order confirmation acknowledging receipt does not necessarily mean that the order has been finally accepted or dispatched.
7.3. An order may be subject to stock availability, seller confirmation, payment authorization, verification checks, and delivery feasibility.
7.4. OCLMart or the relevant seller may decline or cancel an order where there is a legitimate reason, including stock unavailability, a genuine pricing error, suspected fraud, payment failure, legal restrictions, or inability to deliver to the selected destination.
7.5. If an order is cancelled after payment has been received, any refund due will be processed in accordance with our Return, Refund & Cancellation Policy and applicable law.
7.6. Customers should review order details carefully before confirming a purchase, including product specifications, quantity, delivery address, contact details, and total payable amount.
8. Payment Terms
8.1. OCLMart may support payment methods such as mobile money, bank transfers, debit or credit cards, and other payment methods made available at checkout.
8.2. Available payment methods may vary by country, seller, transaction value, currency, and service provider.
8.3. Customers must use payment methods they are legally authorized to use.
8.4. Payments may be processed by third-party payment service providers. Their services may be subject to separate terms, verification requirements, and privacy policies.
8.5. OCLMart will not ask customers to disclose their full card PIN, mobile money PIN, or other confidential payment authentication credentials through public communications.
8.6. Where a payment fails, is reversed, or is flagged for verification, order processing may be delayed or suspended until the issue is resolved.
8.7. Customers should retain order confirmations and payment records to assist with inquiries or disputes.
8.8. Any payment collection, holding, transfer, or settlement service offered by OCLMart will be subject to the relevant service terms and applicable financial and payment laws.
9. Delivery, Shipping, and Fulfilment
9.1. Delivery options, estimated delivery times, and applicable charges will be communicated during the ordering process or through the relevant seller.
9.2. Delivery estimates are not guaranteed unless expressly stated as guaranteed in the transaction terms.
9.3. Delivery may be affected by factors such as stock availability, seller processing time, customs clearance, weather, transport disruptions, public holidays, security conditions, and other circumstances beyond reasonable control.
9.4. Customers must provide a complete and accurate delivery address and accessible contact details.
9.5. Customers should make reasonable arrangements to receive their orders. Additional charges or return arrangements arising from an incorrect address, missed delivery, or failure to collect a parcel will be applied only where lawful and properly disclosed.
9.6. Risk of loss and responsibility for a product during transit will be determined by the applicable transaction terms and relevant law. These Terms do not automatically transfer risk to the customer before the transfer required by law.
9.7. If a product arrives damaged, defective, incorrect, incomplete, or materially different from its description, the customer should contact OCLMart promptly using the contact details provided in the Return, Refund & Cancellation Policy.
9.8. For international shipments, delivery times may depend on export procedures, customs clearance, import requirements, and local delivery partners.
10. Customs, Import Duties, and Cross-Border Transactions
10.1. Customers purchasing products across international borders must comply with the applicable import, customs, product safety, and other laws of the destination country.
10.2. Customs duties, import taxes, inspection fees, and other charges may apply depending on the product, declared value, country of origin, and destination.
10.3. The party responsible for customs clearance and payment of duties should be identified in the transaction or shipping terms where relevant.
10.4. Customers must not request that a seller misdeclare a product’s value, origin, nature, or quantity or provide false customs documentation.
10.5. Certain products may be restricted or prohibited from importation into particular countries. Customers should confirm any relevant restrictions before placing an order.
10.6. OCLMart or a seller may decline, suspend, or cancel a transaction where fulfilling it would violate applicable trade restrictions or other legal requirements.
11. Returns, Refunds, and Cancellations
11.1. Returns, refunds, exchanges, replacements, and order cancellations are governed by OCLMart’s separate Return, Refund & Cancellation Policy, which forms part of these Terms.
11.2. Customers should review that policy before purchasing. It explains the applicable return period, request procedure, eligibility conditions, shipping arrangements, cancellation charges, and refund process.
11.3. OCLMart’s published policy provides a reporting period of seven (7) working days from delivery for covered return requests, subject to applicable law and any longer statutory rights.
11.4. A change-of-mind return or cancellation fee may apply only as described in the published policy, where lawful and disclosed before purchase.
11.5. No change-of-mind fee will be imposed where prohibited by law or where the applicable policy excludes the fee, including qualifying cases involving defective, damaged, incorrect, or materially misdescribed products.
11.6. Nothing in these Terms limits mandatory consumer rights, including rights relating to defective goods, misleading descriptions, non-delivery, or other remedies that cannot lawfully be excluded.
12. Seller Obligations
Sellers using OCLMart must:
12.1. Provide truthful and accurate product descriptions, photographs, specifications, prices, and stock information.
12.2. Offer only products they are legally authorized to sell.
12.3. Comply with applicable consumer protection, product safety, intellectual property, tax, trade, and other legal requirements.
12.4. Honour accepted orders and communicate promptly regarding delays, stock shortages, or fulfilment problems.
12.5. Package products appropriately and comply with applicable shipping and labelling requirements.
12.6. Respond reasonably to customer complaints, return requests, warranty claims, and product safety concerns.
12.7. Avoid counterfeit goods, misleading advertising, unauthorized use of trademarks, fraudulent listings, and prohibited products.
12.8. Provide accurate business and contact information when requested as part of marketplace verification.
OCLMart may review seller activity and take appropriate action against sellers who violate these Terms or applicable law.

You agree not to:
13.1. Use OCLMart for fraud, money laundering, unlawful trade, or any other illegal activity.
13.2. Submit false orders, false payment confirmations, fraudulent refund claims, or misleading account information.
13.3. Upload malware, interfere with the website, attempt unauthorized access, or disrupt marketplace operations.
13.4. Copy, scrape, collect, or commercially exploit marketplace data without authorization, except where permitted by law.
13.5. Infringe intellectual property rights or upload content that is unlawful, deceptive, threatening, or abusive.
13.6. Manipulate reviews, ratings, promotions, or seller performance information.
13.7. Circumvent applicable payment, verification, security, or trade compliance measures.
13.8. Use the platform in a way that unlawfully harms OCLMart, sellers, customers, or other third parties.
Where a breach is reasonably suspected, OCLMart may investigate and take proportionate action, including restricting access, removing content, suspending an account, cancelling an affected transaction, or referring suspected unlawful conduct to the appropriate authorities.
14. Reviews, Ratings, and User Content
14.1. Customers may be permitted to submit reviews, ratings, questions, photographs, or other content relating to products or sellers.
14.2. Content must be truthful, relevant, lawful, and based on a genuine experience where it purports to be a customer review.
14.3. Users must not submit fake reviews, impersonate other people, publish confidential information, or post content that infringes another person’s rights.
14.4. By submitting content to OCLMart, you grant OCLMart a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and use that content for operating, promoting, and improving the marketplace, subject to applicable law and our privacy commitments.
14.5. You retain ownership of content you lawfully own. This licence does not transfer ownership of your intellectual property to OCLMart.
14.6. OCLMart may remove or moderate content where reasonably necessary to address legal concerns, fraud, abuse, or violations of these Terms.
15. Intellectual Property
15.1. The OCLMart name, logo, website design, platform software, text, graphics, and other materials owned by OCLMart are protected by applicable intellectual property laws.
15.2. You may use the website for lawful personal or business shopping activities in accordance with these Terms.
15.3. You may not reproduce, modify, distribute, commercially exploit, or create derivative works from OCLMart-owned material without prior authorization, except where permitted by law.
15.4. Product photographs, trademarks, descriptions, and other materials supplied by sellers or third parties remain subject to the rights of their respective owners.
15.5. If you believe content on OCLMart infringes your intellectual property rights, you may contact us with sufficient details to identify the material and explain your concern.
16. Privacy and Data Protection
16.1. OCLMart may collect and process personal information necessary to operate the marketplace, create accounts, process orders, coordinate deliveries, provide customer support, prevent fraud, and meet legal obligations.
16.2. Personal information may include names, contact details, delivery addresses, order history, transaction references, and information supplied during customer support or verification processes.
16.3. OCLMart will handle personal data in accordance with its Privacy Policy and applicable data protection laws.
16.4. Where necessary to fulfil an order, relevant information may be shared with sellers, payment providers, delivery companies, warehouse operators, customer support providers, or other service providers.
16.5. International transfers of personal data, where applicable, will be handled in accordance with relevant legal requirements.
16.6. Customers should review the OCLMart Privacy Policy for details about data collection, use, retention, sharing, and applicable privacy rights.
17. Warranties and Product Quality
17.1. Product warranties may be provided by the manufacturer, seller, distributor, or another authorized party. The applicable warranty terms should be reviewed before purchase.
17.2. Customers should retain receipts, order confirmations, warranty documents, and other relevant records.
17.3. OCLMart will communicate relevant warranty information where it is available to us, but we do not independently guarantee every third-party seller’s warranty unless we expressly agree to do so.
17.4. Nothing in these Terms excludes or restricts a warranty, guarantee, or consumer remedy that must be provided under applicable law.
18. Limitation of Liability
18.1. OCLMart will exercise reasonable care in operating the marketplace and providing services under its control.
18.2. To the extent permitted by law, OCLMart is not responsible for losses caused solely by a third party’s independent acts or omissions, inaccurate information supplied by a seller, or circumstances outside OCLMart’s reasonable control.
18.3. OCLMart does not guarantee uninterrupted access to the website, error-free operation, uninterrupted availability of every listing, or the performance of independent sellers and third-party service providers.
18.4. To the extent permitted by law, OCLMart will not be liable for indirect or consequential losses that were not reasonably foreseeable when the relevant transaction was entered into.
18.5. Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury where such limitation is unlawful, breach of non-excludable statutory obligations, or any other liability that cannot legally be excluded or restricted.
18.6. Where OCLMart is legally responsible for a loss, its liability will be determined in accordance with applicable law and the circumstances of the transaction.
19. Indemnity
To the extent permitted by applicable law, a user who breaches these Terms, infringes third- party rights, or uses the platform unlawfully may be responsible for reasonable losses, claims, damages, and costs directly resulting from that breach or unlawful conduct.
This provision does not make a customer responsible for losses caused by OCLMart’s own unlawful conduct or remove any non-excludable consumer rights.
20. Suspension, Termination, and Website Availability
20.1. OCLMart may temporarily suspend or restrict access to the website for maintenance, security, technical repairs, suspected fraud, legal compliance, or other legitimate operational reasons.
20.2. OCLMart may suspend or terminate an account where there are reasonable grounds to establish serious or repeated breaches of these Terms, subject to applicable law and any required notice.
20.3. Customers may stop using the website or request account closure through the available support channels, subject to outstanding orders, legal retention obligations, and other lawful requirements.
20.4. Account closure does not cancel an existing order, payment obligation, refund entitlement, or other accrued right unless the relevant matter is separately resolved.
21. Third-Party Services and Links
21.1. The website may contain links to third-party websites or integrate third-party payment, delivery, communication, or other services.
21.2. Those services may be governed by separate terms and privacy policies.
21.3. OCLMart does not control every third-party website or service and is not responsible for independent third-party content or practices, except to the extent liability arises under applicable law.
22. Force Majeure
OCLMart will not be treated as having breached these Terms solely because performance is delayed or prevented by circumstances beyond its reasonable control, such as natural disasters, epidemics, war, civil unrest, government restrictions, customs disruptions, major transport interruptions, widespread network failures, or other comparable events.
OCLMart will take reasonable steps to address the disruption where practicable. This provision does not remove statutory refund rights or other obligations that continue to apply by law.
23. Changes to These Terms
23.1. OCLMart may update these Terms to reflect changes in its services, business operations, technology, legal requirements, or marketplace practices.
23.2. The updated version will be published on the website with a revised effective date.
23.3. Where a change materially affects users or is legally required to be notified, OCLMart will provide notice through an appropriate channel where reasonably practicable.
23.4. Changes will not retrospectively remove rights that have already accrued or override mandatory legal protections.
23.5. Continued use of the website after updated Terms take effect constitutes acceptance of the revised Terms only to the extent permitted by applicable law.
24. Governing Law and Dispute Resolution
24.1. These Terms will be governed by the laws of Kenya, except where mandatory laws of another jurisdiction apply to a particular customer or transaction.
24.2. If a dispute arises, customers are encouraged to contact OCLMart first so that the matter can be reviewed and an appropriate resolution explored.
24.3. Where a dispute cannot be resolved informally, it may be referred to a competent court or other dispute-resolution body with jurisdiction over the matter.
24.4. Nothing in this section prevents a consumer from exercising a mandatory right to bring a claim before a competent authority or court under applicable law.
24.5. For cross-border transactions, applicable consumer protections and mandatory legal requirements in the relevant jurisdiction will continue to apply.
